About This Training

Hazardous Materials

Whether you work for a large or small generator of hazardous waste, a hazardous waste treatment, storage, or disposal facility (TSDF), or transport hazardous waste, you are required to receive training. However, it is not always clear what the scope of this training should be or who requires you to receive training.

For example, if you work for a small-quantity generator of hazardous waste, your employer is not required to have an established training program under RCRA regulations, and is only required to ensure employees handling hazardous waste are familiar with proper handling and emergency procedures.

However, under OSHA and 29 CFR 1910.120, training in the physical and health hazards of chemicals in the work area and training in working with toxic chemicals is required as part of an established Safety and Health Program.

On the other hand, if you work for a large-quantity generator, training is required under both RCRA and OSHA. Furthermore, if you transport the hazardous waste you generate off your site (or treat or store it), you are required to meet the many Department of Transportation (DOT) regulations (49 CFR) that govern the transportation of hazardous materials, as is anyone in the business of transporting your hazardous waste for you.

Many employers, seeing that the training requirements under OSHA that address TSDFs are found in the HAZWOPER regulations, have sent their employees to take HAZWOPER training, which does not meet the complex interwoven training and information requirements for managing and handling hazardous waste under RCRA, OSHA, and the DOT.
